Terms of Service

1. Acceptance

By creating an account or using Voicipher ("Service"), you agree to these Terms. If you are accepting on behalf of a company, you represent that you have the authority to bind that company.

If you do not agree, do not use the Service.

2. The service

Voicipher provides a platform to create, configure, and deploy AI voice agents on your website. The service includes a dashboard, an embeddable widget, speech processing via Sarvam AI, and integrations with Cal.com for meeting bookings.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Your account

  • You must be at least 18 years old and have the legal capacity to enter into contracts.
  • You are responsible for keeping your login credentials secure.
  • You are responsible for all activity that occurs under your account.
  • One account per business entity. You may not share accounts between unrelated businesses.

4. Credits and billing

  • The Service operates on a prepaid credit model. Credits are consumed at a rate of 1 credit per minute of voice call.
  • Credits are non-refundable except as required by applicable law.
  • Credits do not expire as long as your account remains active.
  • If your credit balance reaches zero, voice calls will be blocked until you top up.
  • Prices are displayed in Indian Rupees (INR) inclusive of applicable taxes. We reserve the right to change pricing with 30 days' notice.
  • All payments are processed by Razorpay. By making a payment you also agree to Razorpay's terms of service.

5. Acceptable use

You may not use the Service to:

  • Violate any applicable law or regulation.
  • Impersonate any person or entity, or mislead callers about the AI nature of the agent.
  • Collect sensitive personal data (passwords, payment card numbers, government IDs) from callers via voice.
  • Transmit spam, unsolicited messages, or automated robocalls to users who have not opted in.
  • Attempt to reverse-engineer, scrape, or extract underlying models or infrastructure.
  • Resell or sublicense access to the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Your content

You retain ownership of all content you upload (knowledge base, FAQs, documents). By uploading content, you grant us a limited licence to process it solely for the purpose of providing the Service to you.

You represent that you have the right to use and share all content you upload, and that it does not infringe any third-party intellectual property rights.

7. Voice data and end-user consent

You are responsible for obtaining all necessary consents from your website visitors before enabling the voice widget. This includes:

  • Informing visitors that the agent is AI-powered.
  • Disclosing that voice sessions may be transcribed and analysed.
  • Complying with any applicable telemarketing, recording, or data protection laws in the jurisdictions where you operate.

Voicipher processes voice audio on your behalf as a data processor. You are the data controller for your visitors' data.

8. Uptime and support

We target 99.5% monthly uptime for the API and widget infrastructure, excluding scheduled maintenance. Scheduled maintenance will be announced at least 24 hours in advance.

Support is provided via email during business hours (Monday–Friday, 10 AM–6 PM IST). We aim to respond to all queries within one business day.

9. Limitation of liability

To the maximum extent permitted by law, Voicipher's total liability to you for any claims arising from these Terms or the Service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold Voicipher harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

You may cancel your account at any time from the dashboard. Cancellation takes effect at the end of your current billing cycle. Unused credits are forfeited on cancellation.

We may terminate your account immediately if you materially breach these Terms or if your account remains inactive for more than 12 months with a zero credit balance.

12. Governing law

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Your continued use of the Service after that date constitutes acceptance.
